WOOD-FIRED SAUNA USE WAIVER AND RELEASE OF LIABILITY

This Liability Waiver ("Agreement") is entered into by and between the undersigned ("Customer") and Up North Warmth LLC DBA Metsä Saunas ("Company") as of the date signed below. By signing this Agreement, the Customer agrees to the following terms and conditions:

1. Assumption of Risk

The Customer acknowledges and understands that the use of a sauna, including a wood-fired sauna, involves certain risks, including but not limited to overheating, dehydration, burns, allergic reactions, and other health-related risks. The Customer voluntarily assumes all risks associated with using the sauna.

2. Release of Liability

The Customer agrees to release, waive, and discharge Up North Warmth LLC, its employees, agents, and affiliates from any and all liability, claims, demands, or causes of action arising from or related to the use of the sauna, including injuries, property damage, or death, regardless of whether caused by negligence.

3. Health Considerations

If you have any reservations regarding use, such as medical conditions, underlying health problems, the use of prescription drugs or pregnancy, it is essential that you consult a physician before making a booking. By signing this waiver you understand the risks and have consulted any necessary medical professionals. You understand and take full responsibility for your own health and well-being.

4. Proper Use

Alcohol, nudity and smoking are not permitted in the sauna. Any jewelry should be removed before entering the sauna to prevent burning. 

The Customer agrees to follow proper sauna etiquette at all times. This includes the following but is not limited to:

• Follow all provided safety instructions for the sauna's operation.
• Ensure the sauna is not overheated or used improperly.
• Sauna Sessions of no longer than 30 min at a time. 
• Drinking plenty of water before, during and after a sauna session. 
• Following instructions on how to pour water onto hot rocks. 
• Entering and exiting the sauna in a safe manner. 
• Keeping access points clear to allow other users to exit safely and swiftly if needed.
• Exit immediately if you feel nausea, dizzy, or uncomfortable.
• Anyone under the age of 18 using the sauna must be accompanied by an adult.

5. Indemnification

The Customer agrees to indemnify and hold harmless Up North Warmth LLC against any claims, damages, or expenses (including attorney's fees) arising from the use of the sauna.

6. Acknowledgment

If you are making this booking on behalf of a group, it is your responsibility to make all users aware of the terms and conditions and to practice safe sauna use, sign this form, and make sure others are aware of what to bring and other useful information.

Up North Warmth LLC reserves the right to refuse admission to intoxicated persons or for other reasons that may be deemed a health and safety risk. Refunds will not be offered to anyone refused admission.

The Customer acknowledges that they have read, understood, and voluntarily agreed to this waiver and release.
